These terms explain the use of hoskinsdigitalsolutions.co.uk and how enquiries about Hoskins Digital Solutions Ltd’s agency services are handled. They do not themselves create a paid service agreement or an Atlas subscription.
About us
Hoskins Digital Solutions Ltd is registered in England and Wales under company number 15399629. Our registered office is 40 Riders Lane, Havant, England, PO9 4QJ. Contact: lisa@hoskinsdigitalsolutions.co.uk.
Please contact us at the email above if you have questions about these terms or need an accessible copy.
Website use and service agreements
You may use this website to learn about our services, contact us and access materials made available for that purpose. Please use it lawfully and respect the rights of others. If you disagree with these website terms, please stop using the website.
Sending an enquiry, booking an introductory call or requesting a quote does not commit either party to paid work. Paid services begin under a separately accepted proposal, order or service agreement identifying the scope and commercial terms. If you act for a business, you must have authority to enter that agreement on its behalf.
These website terms do not replace an existing client contract. The agreed service contract controls the services it covers, subject to any rights that cannot lawfully be excluded. Privacy notices explain data handling and are not requests to waive privacy rights.
Agency services and scope
Our agency work may include advertising management, marketing strategy, listing and content services, analytics, conversion improvement and related implementation. Only the work included in your accepted agreement is purchased. That agreement should specify deliverables, dependencies, approval responsibilities, timescales, fees, taxes, payment dates and any minimum term or cancellation notice.
We provide agreed services with reasonable care and skill. Timings depend on the agreed scope, timely client input and any third-party reviews or access requirements. Additional work or material changes to scope must be agreed before extra fees are incurred.
Our clients must provide accurate instructions, relevant product evidence and permission to use the materials and systems supplied for the work. Neither party should request or perform work that breaches applicable law or platform rules. Client approval does not remove our own contractual or legal responsibilities.
Fees and third-party costs
There is no universal agency price or subscription created by these terms. The applicable quote or order sets out what you pay and in which currency. Advertising spend, platform charges, software licences and other external costs must be identified as included or additional before you commit. We do not treat an enquiry or access request as authority to charge you.
Where a service involves recurring payments, the agreed order must explain the amount or calculation method, billing frequency, renewal arrangements and how to cancel before the commitment is made. These website terms do not introduce automatic renewal to an existing agreement.
Cancellation, refunds and any charges for completed work are governed by the accepted service agreement and applicable law. There is no blanket exclusion of refunds merely because a service or deliverable is digital.
Consumer rights
Our agency services are primarily offered to businesses. If you purchase as a consumer, mandatory consumer protections still apply. We will provide any required pre-contract information and cancellation instructions before a consumer purchase. These website terms do not waive rights relating to reasonable care and skill, misdescription, faulty digital content, cancellation or other statutory remedies.
Where UK distance-contract cancellation rights apply, you normally have 14 days from entering the relevant service or digital-content contract to cancel, subject to the applicable rules and exceptions. Starting work during that period requires the relevant express request. Any charge for services supplied before a valid cancellation must satisfy the legal conditions. Loss of cancellation rights for fully performed services or immediately supplied digital content requires the legally required consent and acknowledgements; simply browsing this website does not provide them.
Consumers outside the UK retain any mandatory protections applicable in their country. Contact us if you need the terms for a particular purchase explained before ordering.
Atlas is governed separately
Atlas is an HDS software product. Website descriptions introduce its purpose and features; they do not by themselves grant access, guarantee feature availability or create a subscription.
Atlas access, paid plans, usage limits, account connections, uploads and product features are governed by the Atlas Website and Access Terms at https://hoskinsdigitalsolutions.co.uk/atlas/terms/. Its privacy information is at https://hoskinsdigitalsolutions.co.uk/atlas/privacy/ and provider information at https://hoskinsdigitalsolutions.co.uk/atlas/providers/.
An agency engagement does not automatically include Atlas, and Atlas access does not automatically include agency services. Any combined offering must be expressly described in the relevant order. For Atlas matters, its specific terms apply rather than these general website terms. They cannot exclude mandatory legal rights.
Intellectual property and client materials
The website’s original text, design and branding belong to HDS or its licensors. Third-party names, logos and materials remain the property of their respective owners. You may view pages and download or print material made available for your own evaluation or agreed use. You must not resell, republish or commercially exploit our material without permission or a legal right to do so.
Ownership and licences for commissioned deliverables, source files, pre-existing templates, software and client materials are defined in the relevant service agreement. These website terms do not transfer ownership of your business data or grant us permission to publish your confidential information, results or logo as a case study.
Acceptable use and security
Do not attempt unauthorised access, introduce malicious code, impersonate another person, send unlawful material, harvest personal information or interfere with the operation of the website. Do not submit information you are not entitled to disclose.
We may restrict access where reasonably necessary to address misuse, security risks, maintenance or legal obligations. Restrictions on this public website do not override separate rights under a paid agreement. We cannot promise uninterrupted website access, but this does not excuse a failure to perform obligations under a service contract.
Information and external services
We take reasonable care with website information, but general articles, examples and forecasts may become outdated and should be considered in their context. They are not a personal recommendation to make a particular financial or legal decision. Specific promises made in an accepted agreement remain binding where applicable.
External links and platform integrations may lead to services operated by others. Their terms and privacy notices apply to their own services. We do not control their availability, fees, policies or decisions. An external link is not itself an endorsement or a guarantee of suitability.
Results and liability
Marketing outcomes depend on factors including product quality, price, stock, budgets, competition, market conditions and platform changes. We do not promise particular sales, profits, rankings or approval decisions unless a specific lawful commitment is expressly set out in your service agreement. Our Disclaimer at https://hoskinsdigitalsolutions.co.uk/disclaimer/ explains how to interpret examples and estimates.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or remedy that cannot lawfully be excluded or limited. These terms do not remove duties under data protection law or mandatory consumer rights.
Any negotiated limits for agency services must be set out in the applicable service agreement and remain subject to the law. This page does not impose a blanket exclusion of responsibility for our own breach, or create a new liability cap for existing clients.
Complaints and disputes
Please send complaints to lisa@hoskinsdigitalsolutions.co.uk with the relevant details. We will investigate and seek a fair resolution. Contacting us does not prevent you from exercising legal rights or approaching an appropriate regulator or dispute-resolution body.
These website terms are governed by the law of England and Wales. For business users, disputes about these website terms are subject to the exclusive jurisdiction of the courts of England and Wales. For consumers, this does not remove mandatory protections or any right to bring proceedings in another court available under applicable law.
Updates and other policies
We may revise these terms for future website use, displaying the updated date. Changes do not retrospectively change an accepted service agreement or an Atlas subscription. Changes to those arrangements follow the relevant contract and the law.
Read our Privacy Policy at https://hoskinsdigitalsolutions.co.uk/privacy-policy/ for general HDS website and agency privacy information. If part of these terms cannot lawfully apply, the remaining provisions continue where they can operate fairly and lawfully.
